(hereinafter "Buyer") by Gopher Plumbing Supply Specialty Company, Inc. (hereinafter "Gopher") for goods sold to Buyer or to anyone authorized by Buyer, the undersigned (hereinafter "Guarantor(s)") do hereby personally guarantee payment in full to Gopher, plus interest at the maximum rate allowed by Minnesota Law.
Each Guarantor shall be jointly and severally liable to Gopher. This means that each Guarantor is personally liable for the full balance of the Buyer's account.
In the event that the Buyer fails to pay any sum owed to Gopher within thirty (30) days of Gopher's written request for payment, Gopher shall give written notice to Guarantor(s) of Buyer's failure to pay and request payment by Guarantor(s). In the event that the Guarantor(s) does not pay the payment requested by Gopher in full, within thirty (30) days of Gopher's written notice for payment, Gopher may initiate legal action against the Buyer and/or Guarantor(s) to jointly or individually collect the full balance owed by Buyer.
The Failure of Gopher to demand payment in full from Buyer does not constitute a waiver of Gopher's right under this agreement to collect any sum owed to Gopher by the Buyer.
If it should become necessary for Gopher to refer Buyer's account to an attorney for collection, Guarantor(s) hereby agree(s) to pay all costs incurred by Gopher in the course of such collection, including reasonable attorney's fees.
